			<content:encoded><![CDATA[<p style="text-align: justify;">Anything which is illegal constitutes a crime. The criminal case can be fought with the state prosecuting the criminal in a court of law. A state is taken into consideration as it is the entire state which suffers because of the wrongdoings of a particular group of persons. Depending on the grievous nature of the crime, the punishment can be a jail sentence or a hefty fine. The crown imposes this fine on the perpetrator of the crime. The onus of proving him guilty rests with the prosecution. The case should be proved against the wrongdoer without any reasonable doubt. </p>
<p style="text-align: justify;">Generally, magistrates’ courts are the lowest courts where an appeal in a criminal case is heard. In some cases, the criminals receive an indictment. These are usually very serious cases where the hearing is conducted in a crown’s court. Other crimes, which are not very serious, are conducted in the magistrates’ court. Some cases which cannot be clearly classified can be heard in either of the courts. The defendant will be given a choice in which he can decide whether to be heard in the magistrates’ court or in the crown court which will also have a jury present. </p>
<p style="text-align: justify;">It may so happen that the defendant might not be happy with the decision made by the lower courts. In that case, he may appeal in the higher courts for a more favorable decision. The crown’s court and the Queen’ Bench Division of the High Court are further up in the ladder. Court of appeal and House of Lords are the courts in between in the ladder. There can be many lawyers who will fight the case of the defendant. And until and unless the guilt is proved, the man cannot be given a sentence. And if his guilt is proved, he can be given a very harsh punishment depending on the prosecutor and the judge. </p>
